Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you (the school, institution, or individual user, “School” or “User”) and ShikshaSync (“Company”, “we”, “us”, or “our”) governing your access to and use of the ShikshaSync platform, including all features, tools, APIs, and services offered at shikshasync.in.

By registering an account, clicking “I Agree,” or otherwise using the platform, you confirm that:

• You are authorized to enter into this agreement on behalf of the school or institution
• You have read and understood these Terms
• You agree to comply with all applicable laws and regulations

ShikshaSync provides a cloud-based school management platform that includes, but is not limited to:

• Biometric attendance tracking and management (K30 device integration)
• AI-powered academic content generation (study notes, PYQs, model answers)
• Parent–teacher–admin communication and ticketing
• WhatsApp Business API notifications for parents
• Student and teacher management portals
• Government compliance data export tools
• Multilingual support via Bhashini and Google Translate
• Real-time dashboards and analytics

ShikshaSync may modify, update, or discontinue any feature at any time with reasonable prior notice to active subscribers.

3.1 Registration

Schools register through our onboarding process. The registering principal or administrator is the primary account holder and is responsible for all activity under that account.

3.2 Account Security

• You are responsible for keeping all login credentials confidential
• You must immediately notify us of any unauthorized access at someshshukla2004@gmail.com
• ShikshaSync is not liable for losses resulting from unauthorized access due to your failure to maintain credential security

3.3 Accurate Information

You agree to provide accurate, current, and complete information and to keep it updated.

3.4 Multiple Users

Administrators may create accounts for teachers, staff, students, and parents. Each account is subject to these Terms, and the administrator is responsible for ensuring all users comply.

You agree to use ShikshaSync only for lawful school-management purposes. You must NOT:

• Use the platform to harass, abuse, or harm any person
• Upload or transmit malware, viruses, or malicious code
• Attempt to gain unauthorized access to any other school’s data or system
• Send spam or unsolicited commercial messages
• Reverse engineer, decompile, or attempt to extract source code
• Resell, sublicense, or commercially exploit any part of the platform without written consent
• Use AI content generation for anything other than legitimate educational use
• Collect personal data of users beyond what is needed for school operations
• Violate any applicable law, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and other applicable Indian data protection laws

Violations may result in immediate account suspension or termination.

5.1 Your Data

All data entered into ShikshaSync by your school — student records, attendance data, teacher information, and parent contacts — remains the property of your school. ShikshaSync acts as a data processor on your behalf.

5.2 School as Data Fiduciary

The school is the Data Fiduciary (data controller) under the Digital Personal Data Protection Act, 2023, and ShikshaSync acts as a Data Processor on the school’s behalf. The school is responsible for:

• Obtaining lawful, verifiable consent from parents/guardians for data collection
• Ensuring data entered into ShikshaSync is accurate and lawfully obtained
• Complying with applicable data protection regulations
• Managing data-access permissions for teachers, staff, and other users

5.3 Data Portability

On request, ShikshaSync provides your school’s data in a machine-readable export within 30 days. On termination, data is retained for 30 days before secure deletion, giving you time to export it.

ShikshaSync uses the Meta WhatsApp Business API to notify parents. By activating WhatsApp notifications, you agree to the following:

6.1 School Obligations

• All parent phone numbers in your database were collected with lawful consent
• You will use WhatsApp notifications only for legitimate school communications
• You will not send spam, promotions, or content unrelated to school operations
• You will honor opt-out requests promptly

6.2 Compliance with Meta Policies

Use of WhatsApp notifications is subject to Meta’s WhatsApp Business Policy. ShikshaSync sends messages only using pre-approved templates; schools must not attempt to bypass template requirements.

6.3 No Guarantee of Delivery

WhatsApp delivery depends on the recipient’s device, network, and WhatsApp uptime. ShikshaSync does not guarantee delivery and is not liable for non-delivery.

7.1 ShikshaSync IP

The ShikshaSync platform — its software, code, design, logos, trademarks, and documentation — is the exclusive property of ShikshaSync. You receive a limited, non-exclusive, non-transferable license to use the platform solely for your school’s internal management.

7.2 AI-Generated Content

Study notes, question papers, model answers, and other AI-generated content created for your school are licensed to your school for educational use. ShikshaSync retains no claim over content generated for your students.

7.3 Feedback

Feedback or suggestions you provide may be used by ShikshaSync to improve our services without obligation to compensate you.

8.1 Subscription Plans

ShikshaSync offers subscription plans. Current pricing is listed on our website and may be updated with 30 days’ notice to existing subscribers.

8.2 Payment

• Subscription fees are due in advance at the start of each billing cycle
• Accepted methods include UPI, bank transfer, and major Indian debit/credit cards
• All prices are in Indian Rupees (INR) and inclusive of applicable GST

8.3 Free Trial

We offer a 30-day free trial with full access. No credit card is required for the trial.

8.4 Refunds

Subscription fees are non-refundable except where required by Indian consumer protection law. If you believe you were charged in error, contact us within 7 days at someshshukla2004@gmail.com.

8.5 Government & Public Schools

For government, government-aided, and public schools onboarded under a government programme, tender, or memorandum of understanding (MoU), the commercial terms in this Section 8 may be modified, reduced, or waived. In such cases, the specific terms agreed in the applicable government order or MoU shall prevail over the standard subscription terms above.

9.1 By You

You may cancel at any time by contacting us. Access continues until the end of your paid billing period.

9.2 By ShikshaSync

We may suspend or terminate your account immediately if:

• You violate these Terms
• You use the platform for fraudulent or illegal purposes
• You fail to pay fees after a 7-day grace period
• Continued access would expose us or other users to legal risk

9.3 Effect of Termination

On termination, access is revoked. Your data is retained for 30 days for export, after which it is permanently deleted.

To the maximum extent permitted by Indian law, ShikshaSync is not liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data due to circumstances beyond our reasonable control
• Service interruptions caused by third-party providers (WhatsApp/Meta, Google, AWS)
• Errors or inaccuracies in AI-generated content
• Actions taken by Meta resulting from misuse of the WhatsApp integration
• Losses arising from biometric device malfunctions beyond our software control

Our total aggregate liability for any claims under these Terms shall not exceed the total subscription fees you paid in the three months preceding the claim.

You agree to indemnify and hold harmless ShikshaSync and its team from claims, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from:

• Your use of the ShikshaSync platform
• Your violation of these Terms
• Your violation of any third-party rights, including privacy rights
• Any data you submit that violates applicable law
• Misuse of the WhatsApp notification feature

These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in India.

We encourage you to contact us first at someshshukla2004@gmail.com to resolve any dispute informally before initiating formal proceedings.

Material changes will be communicated by:

• Updating the “Last Updated” date on this page
• Sending an email notification to school administrators
• Displaying an in-app notice for 14 days following the update

Continued use after the effective date of updated Terms constitutes acceptance.
